Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to:
the hazard of fire and explosion at the Ohmstede, La Porte facility on or
about the date
of May 6, 2007 at approximately 6:30 AM, while attempting to ignite the
De-Coker
Furnace.
Among other methods, one feasible and acceptable abatement method to
correct this
hazard is prior to each furnace heating system startup, provisions shall
be made for the
removal of all flammable vapors and gases that have entered the heating
chambers during
the shutdown period as required under paragraph 8.4.1.1 and paragraph
8.9.1 of National
Fire Protection Association NFPA 86, Standard for Ovens and Furnaces 2007
Edition.
