Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to being struck by from falling materials and/or equipment:
(a) Congelio gas well #5: On or about 05/18/09 a "Hydrair" wire rope hoist
was modified by
removing the hook and latch assembly and installing a 1/2 inch, 16 foot
long, single leg alloy
chain sling by threading the wire rope through a link of the alloy chain
and knotting the end of
the wire rope.
Among other methods, one feasible and acceptable means of abatement is to
follow the
"Recommended Practice for Procedures for Inspections, Maintenance, Repair
and Remanufacture
of Hoisting Equipment", API Recommended Practice 8B, Seventh Edition,
dated March 2002,
ANSI/API RP 8B/ISO 13534-2000, paragraphs 4.1.1 and 4.1.2.2.  The
user/owner
shall develop
inspection, maintenance, repair and remanufacture procedures consistent
with widely accepted
industry practices.
