Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which was free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to unsafe loading and unloading of heavy equipment from
trailers.
a)Side Yard - An operator was driving a Dynapac compact roller, model
number
CC142C, serial number 60213087, onto a flatbed trailer and was not in
compliance with the manufacture's operations manual and the Construction
Industry Manufactures Association's requirements for compact rollers as
evidenced by noted hazards, such as but not limited to;
1.The operator was not wearing a seat belt that was required to be used on
compact
rollers that were provided with Roll Over Protective Structures.
2.The trailer onto which the compact roller was to be placed upon was not
on a
level ground surface.
3.A section of the ramp that was used to get the compact roller onto the
trailer was
a piece of 2 inch by 10 inch timber and not securely attached to the
trailer.
4.The operator did not approach the trailer squarely with the compact
roller.
5.The operator was not provided with adequate training in the proper use
of the
compact roller or the proper safe procedures for the loading of the
compactor on
to a flatbed trailer.
Among other methods, one feasible and acceptable abatement methods to
correct this hazard is
to follow and enforce established manufacturers safety and operational
procedures as well as the
Construction Industry Manufacturers Association safety manual.
