Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed the hazard of being Struck by motor vehicles:
a) Route 80  Mile post # 36 Eastbound side
Employees were working on Route 80 eastbound without the use of traffic
control devices to
protect them from being struck by oncoming traffic
Violation observed on or about 11/14/2006.
b) Route 80: Mile post 36 Center Divider
Employee was observed walking on the "Jersey Barrier" that divide both the
eastbound and
westbound lanes. There was no traffic control devices to protect the
employee from being struck
on coming traffic from the westbound lane.
Violation observed on or about 11/14/2006.
One Feasible means, among others, to correct this hazard is follow ANSI
D6-1.1988 Manual
on Uniform Traffic Control Devices.
