Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was exposed a fall hazard: (a)L&L Design Builders Inc., at 1999 Broadway, Denver, CO 80202: On November 14, 2006 an employee was standing on the midrail of a Genie Self- Propelled Scissors to install drywall soffett. This condition exposed the employee to a fall hazard of approximately 32 feet to the concrete floor. Abatement Note: American National Standards Institute A92.6-1999, Self-Propelled Elevating Work Platforms, paragraph 8.10(9) directs that personnel shall stand only on the platform and not climb on the midrail or toprail. The paragraph also prohibits the use of planks, ladders, or other devices to gain additional height. Among other methods, one feasible and acceptable abatement method to correct this hazard is to train the employees in the proper use of the scissor lift. Proper and safe use of the scissor lift is detailed in ANSI A92.6-1999. Abatement Note: Abatement certification and documentation are required for this item (see enclosed "Sample Abatement-Certification Letter").-Certification
