Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards while handling stone slabs: (a)Genuine Stone Tops, Inc., 5360 Washington St., Denver, CO: On or about 2/7/2007 and at times prior thereto, the employer did not ensure that employees who participated in slab transfers stayed out of the fall shadow of the slab while it was being transferred from storage to a work table. The outside storage of smaller slabs is not secure and increases the risk of slabs kicking out at the bottom. These conditions expose employees to crushing hazards which can lead to serious injury or death. Among other methods, one feasible and acceptable abatement method to correct this hazard is: 1.Train employees to stay out of the fall shadow of the slab when steadying the slab during movement. This training should include both when the slab is being carried to the table and as the slab is being laid flat on the table. 2.Require supervisors to enforce the rule that employees stay out of the fall shadow of the slab(s). 3.Improve the outside storage racks to the same standards as your inside storage racks. Abatement Note: Abatement certification and documentation are required for this item (see enclosed "Sample Abatement-Certification Letter").
