Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a 11-foot fall hazard while being hoisted above the ground by an industrial forklift truck: (a) Genuine Stone Tops, Inc., 5360 Washington, Street, Unit#D, Denver, CO 80216: The cloth filters for the box filters located about 11.5 feet above the concrete floor located in the granite shop are cleaned periodically. A Hyster, model S80XLBCS, number 7156 is used to lift an employee while standing on a wooden pallet that is attached to the tines of the forklift. The pallet is 48 inches by 40 inches and contained a number of loose boards. This exposed employees to injuries associated with falling 11 feet to a concrete floor. Abatement Note: Abatement Certification and documentation are required for this item (see enclosed "Sample Abatement-Certification Letter").
