Section 5(a)(1) of the Occupational Safety and Health Act of 19170: The employer did not furnish to each of its employees a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck by hazard which could inflict death or serious injury while transferring granite slabs in the storage yard: (a) Colorado Custom Stone, Inc., 1450 Grove St., Denver, CO 80204: On or before 9/24/07, employees were exposed to struck by hazards while transferring granite/marble slabs in the storage yard area. The granite/marble slabs are stored in the yard adjacent to the fabrication shop. The slabs were stored on an "A" frame racking system. When retrieving the slabs, employees are required to separate the slab from the others in order to attach the clamp on the forklift extension. This activity placed the employees in the middle of the granite slab racking system in between slabs. This condition exposed employees to a struck by hazard with injury including, but not limited to, broken bones, or death. Abatement note: Abatement certification is required for this item (see enclosed "Sample Abatement-Certification Letter").
