Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck by hazard which could inflict death or serious injury while transferring granite slabs from the delivery trucks to the fabrication shop: (a)Solid Rock, LLC, 1031 West Center Avenue, Denver, CO 80223: The granite slabs were stored inside the fabrication shop. They were stored on metal and wood rack at an angle of 80 degrees or less. The slabs were not secured with any type of device that could be used to control the movement of the slabs while they were being attached to the extension of the forklift. When transporting a slab, employees stood in the fall shadow of the granite slab. Employees were also observed lifting and moving the slabs manually. This posed a "struck-by" hazard to the employees performing the work. Abatement Note: Abatement certification is required for this item (see enclosed "Sample Abatement Certification Letter"). Among other methods, one feasible and acceptable abatement method to correct this hazard is to perform the following: A slab wedge can be used to separate the granite slabs from one another by having two employees stand to the side of the slab and insert the wedge so that a clamping device can be placed onto the slab to be moved. Employees should be trained never to stand in the fall shadow of the granite slab while transporting it.
