Labor and Employment Article, Section 5-104(a): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a)Date of Violation:01/26/07 Location:Dip Tank Area Condition:In an area where metal parts were dipped into tanks, containing chemicals ranging from 1 to 13 pH, the emergency shower did not meet the minimum requirements of ANSI Z358.1-1990, sections 4.2 and 4.3, in that the control valve would not stay open when activated, and the actuator was greater than 69 inches above the floor. Among other methods, one feasible and acceptable abatement method to correct this hazard is the installation of a control valve that will stay on until intentionally shut off. The actuator shall be lowered from 73 inches to 69 inches above the floor. Abatement documentation (photographs, receipts, copies of programs, training certification, etc.) is required for this item.
