employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to: An employee was exposed to the hazard of falling while using a
scissor lift as a
work platform. S & S Quality Construction, Inc. Site Instance - An
employee was standing
on the end section top-rail and leaning forward while fastening a piece of
steel; thus exposed to
a fall of approximately 12 feet to the concrete floor below. A feasible
means of abatement would
be to comply with the American National Standards Institute, ANSI
A92.6-1999 Standard
for Self-Propelled Elevating Work Platforms, Section 8.10(9) entitled
Operator Warnings
And Instructions which states "Personnel shall maintain a firm footing on
the platform floor
while working thereon" and "Climbing by occupants on the mid-rail or
top-rail of the aerial
platform is prohibited".
On or about February  23, 2007 at the work-site located at NEA Turf - Hwy
49 in
Paragould, Arkansas an employee was standing on the end section top-rail
and leaning
over the top guardrail while fastening a piece of steel ; thus exposed to
a fall of
approximately 12 feet to the concrete floor below.
