Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: V.O. Menuez & Son, Inc., worksite: During road scraping activities on State Route 94, an employee was exposed to the hazard of being struck by vehicular traffic due to the lack of wearing reflective apparel. Among other feasible methods of abatement, employees can wear appropriate traffic control high visibility clothing that meets ANSI/ISEA 107-2004 Standard for Class 1 and Class 2 safety garments.
