Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to potential crushing hazards from falling loads and/or lifted parts: (a) Service bay area, 301 38th Street SW, Fargo, ND, for the employees who were exposed to crushing hazards while working underneath of Challenger automotive lifts that had not had routine maintenance performed or annual certification inspections. Abatement Note: Among other methods, one feasible and acceptable method would be to follow the requirements of ANSI/ALI ALOIM and/or ANSI B153.1 which include, among other requirements, the following: 1. Institute a preventative maintenance program according to the manufacturers specifications. 2. Schedule and complete all periodic and annual inspections. Abatement Note: Abatement certification is required for this item (see enclosed "Sample Abatement Certification Letter").tion
