General-duty citation text
T.C.A. 50-3-105(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: In that, the employer did not establish and implement a written procedure for heating rounds of ammunition in a TESTEquity Model 1020C Temperature Chamber. In the absence of a written procedure detailing operational steps and operating limits specific to the product being heated, ammunition could be advertently heated to a temperature capable of causing the ammunition to explode either inside the temperature chamber projecting fragments from the chamber, or upon removal from the chamber. Resulting fragments could strike employees operating the chamber, employees handing the ammunition after removal from the chamber, and employees in the area containing the chamber, causing serious injury. The feasibility of ammunition to be overheated was established with a previous incident where the implementation of improper operating procedures caused ammunition to explode inside the chamber. As feasible abatement of this hazard, the employer could establish a written operating procedure detailing operational steps to safely perform the heating of ammunition, which includes a maximum test temperature for particular ammunition tested. In addition, operators of the temperature chamber should be trained to the written procedure.
