Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or were likely to cause death or serious physical harm to employees in that employees were exposed to hazards while working at elevated heights: On or about August 6, 2007, an employee was exposed to fall hazards while working from a platform resting on the forks of a forklift because the platform did not indicate the maximum work load including personnel and equipment, the weight of the empty platform, or the minimum capacity of the truck on which the platform could be used. Among other methods, one feasible and acceptable abatement method to correct his hazard is to obtain and use a platform meeting the requirements of ASME B56.1-2004, American Society of Mechanical Engineers Safety Standard for Low Lift and High Lift Trucks.
