Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: At the shop, on or about May 21, 2007 and prior thereto, employees were operating a Nissan forklift were not wearing seat belts, exposing them to the hazard of being struck by the forklift in the event of a tip-over accident. Feasible and acceptable abatement methods to correct this hazard include installing seat belts on the forklift, establishing a policy that requires the use of seat belts, communicating it to employees and enforcing the use of the seat belts.
