Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to severe burn injuries from the potential dust explosion that could have resulted from, or have been exacerbated by, recycling the air back into the building without a high speed abort gate, a lack of a back flash damper on the exhaust portion of the ductwork and a lack of chokes used on the screw conveyor system transporting waste from the cyclone to the hopper: (a)The dust collection system was used to collect wood dust and recycled the air back into the building but there was no high speed abort system in the event of a fire or explosion, on or about May 17, 2007. (b)The dust collection system and the ductwork used to collect the wood dust was not protected by a back flash damper in the event of a fire or explosion, on or about May 17, 2007. (c)At the base of the cyclone the wood dust was conveyed to a tote bin by a screw conveyor that was not protected by chokes in the event of a fire or explosion, on or about May 17, 2007. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THESE HAZARDS INCLUDES FOLLOWING NFPA 664, STANDARD FOR PREVENTION OF FIRES AND EXPLOSIONS IN WOOD PROCESSING AND WOODWORKING FACILITIES, 2007 EDITION, INCLUDING BUT NOT LIMITED TO: PROVIDE A HIGH SPEED ABORT SYSTEM ON THE RETURN AIR DUCTWORK, INSTALL A BACK FLASH DAMPER ON THE EXHAUST DUCTWORK AND INSTALL CHOKES TO PROTECT THE SCREW CONVEYORS VERIFICATION REQUIRED
