Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to dust explosion, deflagration or other fire hazards from improperly designed ventilation systems for the collection of aluminum dust: (a)Grinding and Assembly - The dry type Dust Kop dust collector was not located outside the building on or about May 20, 2008. (b)Grinding and Assembly - The dry type Torit dust collector was not located outside the building on or about May 20, 2008. (c)Grinding Area - The dry type Industrial Air, Inc. dust collector was not located outside the building on or about May 20, 2008. (d)Grinding and Assembly - The dry type Dust Kop dust collection system had branch ducts disconnected and unused portions of the system blanked off without means to provided to maintain required air flow. (e)Grinding and Assembly - The dry type Dust Kop dust collection system sections flexible hose that was not bonded and grounded to minimized accumulation of static electric charge. (f)Grinding and Assembly - Air from the dry type Dust Kop dust collector was recirculated into the building, on or about May 20, 2008. (g)Grinding and Assembly - Air from the dry type Torit dust collector was recirculated into the building, on or about May 20, 2008. (h)Grinding Area - Air from the dry type Industrial Air, Inc. dust collector was recirculated into the building, on or about May 20, 2008. (i)Grinding Area - The blower on the Dust Kop ventilation system for drawing dust laden air into the collector was not located on the clean air side of the collector, on or about May 20, 2008. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THESE HAZARDS INCLUDE FOLLOWING NFPA 484 STANDARD FOR COMBUSTIBLE METALS 2006 EDITION WHICH SPECIFIES DRY TYPE DUST COLLECTORS SHALL BE LOCATED OUTSIDE OF BUILDINGS, BRANCH DUCTS SHALL NOT BE DISCONNECTED NOR SHALL UNUSED PORTIONS OF THE SYSTEM BE BLANKED OFF WITHOUT MEANS BEING PROVIDED TO MAINTAIN REQUIRED AIRFLOW, DUCT SYSTEMS, DUST COLLECTORS, AND DUST PRODUCING MACHINERY SHALL BE BONDED AND GROUNDED TO MINIMIZE ACCUMULATIONS OF STATIC ELECTRICITY, RECYCLING OF AIR FROM DRY TYPE DUST COLLECTORS INTO BUILDINGS SHALL BE PROHIBITED AND THE BLOWER FORDRAWING THE DUST LADEN AIR INTO THE COLLECTOR SHALL BE LOCATED ONT THE CLEAN AIR SIDE OF THE COLLECTOR.
