Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of capsizing a vessel due to overloading. a) Under Route 70 Bridge Pier 11 Manasquan River: Employees were working on a 20' by 50' barge loaded with debris which became unstable and capsized, on or about 4/18/07. One feasible means of abatement is to consult with the manufacturer on stability and capacity limitations, and follow the Flexifloat Construction Systems design drawings and specifications for safe loading operations. NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASE FILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION OR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED AS PER 29 CFR 1903.19.
