Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee did not follow a machine operator's manual instructions. a) Route 70 Bridge, Manasquan, NJ 08736 - An excavator operator did not follow the manufacturer's directions contained in the operator's manual to prevent accidental movement of the excavator. The excavator was inadvertently moved when the controls and safety devices were not properly positioned. On or about 06/16/08. One feasible and acceptable abatement method is for operators to follow the procedures contained in the excavator operator's manual, including but not limited to positioning levers and/or controls in neutral, setting the parking brake, and engaging the transmission neutral lock. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
