Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by lightning. (a) On September 8, 2008 employees working on the red iron building were exposed to being struck by lightning when they were allow to continue working during a thunderstorm that produced high winds, driving rain and lightning strikes in the vicinity of the building. Among other methods, one feasible and acceptable abatement method to correct this hazard is to develop an emergency action plan that addresses when employees should be removed from the construction site to safe a location, based on weather reports or personal observation, that there is a potential for inclement weather in the area. ABATEMENT DOCUMENTATION AND CERTIFICATION IS REQUIRED
