OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by hazard.     The employer failed to ensure that a bundle of approximately 15 metal panels were secured to prevent displacement of the panels while being hoisted to the upper deck of a partially constructed pre0engineered canopy roof.     On or about December 21, 2015, an employee was struck-by metal panels while engaged in setting anchor points on a 20 X 50 ft. pre-engineered metal canopy roof and fell to the lower concrete level resulting in his death.    Among other methods, some feasible and acceptable abatement methods to correct this hazard would be: to ensure loads of panels are secured to prevent displacement; ensure no employee is in the area of staging of the panels to prevent a struck-by hazard; or retrain personnel on the handling of loads being lifted to an upper level.
