Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish to each of his employees employment and a place of employment
which were free from
recognized hazards that were causing or likely to cause death or serious
physical harm to
employees in that employees were exposed to the hazard of an explosion,
deflagration, or a fire
because the combustible dust was not kept to a minimum by both capturing
it at the point of
generation and minimizing escape of fugitive combustible dust. Cleaning
was performed in a
manner which generated dust clouds:
(a) Batter Package Line, Bagger area: The employer did not prevent the
escape of dust from
packaging equipment.
ABATEMENT NOTE: Among other methods, one feasible and acceptable abatement
method
to correct this hazard is to implement the requirement of NFPA 61 (2002)
Sections 10.1 and
10.3.1.3 to enclose and, if necessary, vent or air aspirate the packaging
to
collect the dust
normally emitted by rapid air displacement during filling.
(b) Batter Package Line, bagger area: Compressed air was used to clean up
combustible dust
accumulation in the presence of ignition sources. Compressed air is used
periodically with the
packaging line running when there is an escape of dust at the bagging area.
ABATEMENT NOTE: Among other methods, one feasible and acceptable abatement
method
to correct this hazard is to periodically clean up dusts by using
vacuum-cleaning devices
designed for handling combustible dusts. Compressed air can only be used
after all machinery
in the area has been shut down and all sources of ignition controlled as
specified by Section
10.2.2 of the National Fire Protection Association (NFPA) 61 "Standard for
the Prevention of
Fires and Dust Explosions in Agricultural and Food Processing Facilities,"
2002 Edition.

physical harm to
employees in that employees were exposed to the hazard of an explosion or
a fire due to the
ignition of a combustible dust by static discharge:
(a) Batter Package Line, bagger area: Flexible duct hose and plastic (PVC)
pipe were used at
as part of the duct work to convey flour dust creating the potential for a
combustible dust
explosion inside the system.
ABATEMENT NOTE: Among other methods, one feasible and acceptable abatement
method
to correct this hazard is to comply with the National Fire Protection
Association (NFPA) 61
"Standard for the Prevention of Fires and Dust Explosions in Agricultural
and Food Processing
Facilities," 2002 Edition. This includes ensuring that all duct work is
electrically
conductive and
grounded and bonded per NFPA 61.
