SCRR 71-112A: Failed to furnish a place of employment which is free of recognized hazards which may cause death or serious physical harm to his employees and comply with this regulation and other occupational safety and health rules and regulations promulgated under Chapter 15 of Title 41, Code of Laws, State of South Carolina, 1976, as amended, as follows: A. Employer knew or should have known that one employee operating the TCM forklift with a broken seat belt was exposed to the hazards of being thrown from the forklift and crushed. A feasible and useful method to correct the hazard, among others, is to install and maintain a working seat belt on the forklift. B. Employer knew or should have known that two employees operating Mitsubishi and Hyster forklifts without wearing a seat belt were exposed to the hazards of being thrown from the forklifts and crushed. A feasible and useful method to correct the hazard, among others, is to require employees to wear a seat belt while operating the forklifts.
