P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard(s) of being thrown out of the cab and getting crushed in the event of collision or forklift turnover. a) Inside Distribution Warehouse and at Loading Dock - Employer was allowing two forklifts to be operated without seatbelts installed to prevent employees from being thrown off in the event of a collision or tip over. One feasible means of abatement would be to install seatbelts on the Nissan Motor Company, Model EGH02A30V, 6000 pound load capacity and the Crown, Model 20WBTF, 2000 pound load capacity forklifts
