P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of amputation during the operation of the Bantam Ironworker: a)Along the south wall of the welding department, on or about January 13, 2010 and at times prior to, employees cut steel bar using the Bantam Ironworker which had a foot pedal that was not protected from accidental actuation, exposing employees to an amputation hazard. Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure that the foot pedal is installed in accordance with ANSI B11.5-1988 (R2008), Safety Requirements for the Construction Care, and Use of Iron Workers, Section 4.3.5 which states, "The foot control shall have a pad to allow an even distribution of the actuating pressure as applied by the operator's foot. The pad shall have a nonslip contact area and shall be attached to the control. The foot control shall be protected so as to inhibit operation from falling or moving objects, or unintended operation by someone accidentally stepping on it." ABATEMENT CERTIFICATION IS REQUIRED.TION
