Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm: Refinery boiler house; on or about April 30, 2007, employee(s) was exposed to the hazards resulting from a boiler combustion chamber explosion, which could subject employee(s) to being struck by a pressure wave, moving boiler structure, flying debris, and high heat. The employee(s) operated and maintained refinery utility steam boilers. Boilers #4 and #5 were not equipped to detect boiler flameouts with an automatic shutoff of fuel to the boilers; additionally the induced draft air control system was inoperative. Among other methods, one feasible and acceptable means to correct this hazard is the installation of combustion management system incorporating flame detection coupled with automated safety fuel shutoff valves activated by the loss of burner flame; and by assuring all boiler systems are maintained in an operative condition.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm: Juncture of the Boiler House and Crude Unit #1 areas; on or about July 2, 2007, employees engaged in operation and maintenance of the areas worked around a natural (purchase) bypass gas line; the gas line was not supported. This exposed the employees to the hazards of fire and unconfined explosion. Among other methods, one feasible and acceptable means would be the installation of adequate piping support for the pipe line.
