Section 5 (a) (1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard(s) of struck-by, caught-in and run over by heavy equipment. At the new subdivision worksite: On or about February 13, 2008, and at times prior thereto, the employer allowed employees to use a Gomaco Command III Trimmer/Paver without the original equipment fenders on the track assembly. The fenders are designed to guard against employee contact with the moving track assembly. One feasible means of abatement for this hazard, among others, is to ensure equipment is maintained and operated in accordance with the manufacturer's operation/service manual and any recognized and generally accepted good engineering practices
