29 CFR 1910.22(a)(1):  All places of employment, passageways, storerooms, and service rooms shall be kept clean and orderly and in a sanitary condition:                                                                                                                                                                                                                                                                                                                                                                                       This violation was observed on or about November 3, 2021, on top of Terex silos 1, 2, and 3 where fire extinguishers, tools, hoses, and a variety of other items covered the walking/working area exposing employees to fall hazards.   Pursuant to 29 CFR 1903.19, within (10) calendar days of the date of this citation, the employer must submit documentation describing the steps taken to ensure all places of employment are be kept clean, orderly, and in a sanitary condition.

1910.28(b)(3)(ii) : Each employee is protected from tripping into or stepping into or through any hole that is less than 4 feet (1.2 m) above a lower level by covers or guardrail systems;  Employees are not protected from falling through any holes that are 4 feet (1.2 m) or more above a lower level.  This violation was revealed on about November 3, 2021:  a)  On top of Terex silo 1 at the facility, a small hole approximately 6" x 9" was not provided with covers or other guarding, exposing employees to the hazard of falls.  b)  On top of Terex silo 2 at the facility, a large hole cut into the walking surface approximately 18" x 24" was not provided with covers or other guarding, exposing employees to the hazard of falls.    c)  On top of Terex silo 3 at the facility, a small hole approximately 6" x 9" was not provided with covers or other guarding, exposing employees to the hazard of falls.  Pursuant to 29 CFR 1903.19, within (10) calendar days of the date of this citation, the employer must submit documentation describing the steps taken to ensure covers, guards or other protective devices are installed around holes in silos to ensure employees are protected from the hazard of falls.

29 CFR 1910.28(b)(11)(ii): Each flight of stairs having at least 3 treads and at least 4 risers was not equipped with stair rail systems and handrails in accordance with Table D-2, Stairway Handrail Requirements:  This violation was observed on or about November 3, 2021, the first eight risers of  the main stairway leading to the top of Terex silos 1, 2, and 3 were missing a handrail on the left-hand side, exposing employees to the hazard of falls.    Pursuant to 29 CFR 1903.19, within (10) calendar days of the date of this citation, the employer must submit documentation describing the steps taken to ensure each flight of stairs having at least 3 treads and at least 4 risers are equipped with stair rails.
