Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards, while utilizing a forklift, which had been modified and used as an elevator: On or about 06/26/07 at Washington, GA: Employees were exposed to struck by and fall hazards, while working at a saw mill. Components of a forklift were used to construct an elevator, which was located under the sawmill. The modified elevator did not meet established elevator standards nor the forklift manufacturer's specifications. "AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS": The employer should immediately remove the modified forklift elevator from service. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
