Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing and caught between hazards in the event of a forklift tipover: On or about June 12, 2008, CSHO observed employees operating the two Komatsu Forklift without the use of a restraint system (seat belt). One feasible and acceptable method in correcting this problem would be to enforce the use of seat belts as required by ASME B56.1-1993 Safety Standard for Low Lift and High Lift Trucks.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to potential fire and explosion hazards due to the improper design and/or location of the facility's dust collection equipment : Production Area-The following deficiencies were noted with the dust collection (air material separator) system: 1)Automatic Powder Coating Spray Room - The dust collector enclosure was not listed for the specific application and it was not designed and/or maintained in a condition that would prevent or minimize the destructive effects of an internal deflagration. 2)Spray booth #1 and #2 - The dust collector enclosure was not listed for the specific application and it was not designed to prevent or minimize the destructive effects of an internal deflagration. 3)Spray booth #1 - A facility-made air filter was used on the recycled air from the dust collector. The employer could not provide evidence to show that the filter used would prevent residual dust in the exhaust air from exceeding levels considered safe for personnel occupational exposure. ABATEMENT NOTES: Among other methods, feasible and acceptable abatement methods to correct the above referenced hazards would be to comply with the National Fire Protection Association (NFPA) 33-2007 " Standard for Spray Application Using Flammable or Combustible Materials," Chapter 15, paragraph 15.8.3 as it applies to dust collection equipment enclosures used in the powder coating industry and Chapter 15, paragraph 15.8.2 for acceptable recycle air filter design requirements that would reduce particulate matter to a safe level.
