29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: Benise-Dowling & Associates, Inc. - on or about June 2, 2012, an employee was required to wear a half-face air-purifying respirator during powder coating operations. The employee had not recieved a medical evaluation to determine that he was medically able to wear the respirator. REPEAT VIOLATION Section 17(a) of the Occupational Safety and Health Act of 1970 and 29 CFR 1910.134(e)(1). Benise-Dowling & Associates, Inc. WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OSHA STANDARD WHICH WAS CONTAINED IN OSHA INSPECTION #311040174 CITATION #1 ITEM #10, ISSUED ON 11/14/08, WITH RESPECT TO A WORKPLACE LOCATED AT 5068 SNAPFINGER WOODS DRIVE, DECATUR, GA 30035. THIS CITATION BECAME A FINAL ORDER ON 11/26/08.
