Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hoist hooks without safety latches: a)959 Market St. Paterson, NJ: The hook of the Yale 1 ton electric hoist was not equipped with a safety latch, on or about 05/20/2008. ABATEMENT NOTE: Among other methods, one feasible and acceptable method to correct this hazard is to equip hoist hooks with safety latches as described in ANSI B30.16-2007 Section 16-1.2.9 (Hooks). A latch shall be provided to bridge the throat opening of the hook and retain, under slack conditions, such items as, but not limited to, slings and chains.
