Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by and crushing hazard: On or about 04/08/2008, at the Western Division Clewiston, in Clewiston, Florida, transfer (or dedicated) train air brake tests were not being performed on the rear car as well as all remaining cars. Among other methods of abatement, one feasible and acceptable method to correct this hazard is to ensure compliance with 49 CFR Part 232.215 for transfer train brake tests. PLEASE NOTE: DOCUMENTATION AND CERTIFICATION OF ABATEMENT IS REQUIRED FOR THIS VIOLATION.
