Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazard of being struck by the backhoe's bucket:
(a)Near the east side of the site, an employee operated a Caterpillar
Backhoe, model
number 416C.  The pins that secured the backhoe's 2 foot wide bucket to
the boom were
secured with wires, bolts and bent nails in place of the pins originally
provided by the
manufacturer.
Among other methods, one feasible and acceptable method to correct this
hazard is to:
(1.) Follow the Association of Equipment manufacturers (AEM) "Safety
Manual for
Operating and Maintenance Personnel" that requires damaged and missing
parts are
repaired or replaced,
(2.) Follow the Manufacturer's Operator Manual by using only service parts
meeting the
manufacturer's specifications, and
(3.) To train operators and maintenance personnel to complete service and
repairs before
equipment is placed back in service.
