T.C.A. 50-3-105(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: In that the employer did not ensure that significantly damaged pallet storage racks were not used to store pallets of automotive parts and/or immediately repaired as recommended by the manufacturer in two instances: 1.) In the approximate center at the main aisle of the warehouse at Bin# 20-12-28-24 where the cross bars on the first level of the storage rack was completely broken off. Additionally, the leg of the upright closest to the main aisle was bent and partially twisted off the base plate. 2.) At the main aisle near the Production Area of the warehouse at Bin# 25-20-44-13 where the bars at the first level of the end column were completely sheared off on one end and partially sheared off the other end. ABATEMENT VERIFICATION REQUIREDTION
