Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to multiple trauma from falls greater than 10 feet:
a)  87 Bright Street, Jersey City, NJ:
An unsecured pallet was placed on the forks of the forklift and was being
used as a personnel
lift platform for access to the upper floor.  The company President was
exposed to greater than
10 foot falls while relocating material to the second floor while standing
on a wood pallet which
was lifted by a Yale forklift.
Violation observed on or about 07/25/2007.
NOTE:  "Among other methods, one feasible and acceptable abatement method
to correct this
hazard is:  (1) to follow guildelines listed in the American Society of
Mechanical Engineers
(ASME) B56.1 2000, Safety Standard for Low and High Lift Trucks, Section
4.17, Elevating
Personnel, and with a platform that meets ASME B56.1, 2000, Section 7.36,
Platforms-
Elevating and provide the restraining means such as a railing, chains,
cables, body belts with
lanyards, or deceleration devices that are in place and properly used.
(2) Provide a "safety
platform" used in accordance with ANSI B56.1-1975, Part II, Section 513 or
equivalent
protection.
