5(a)(1) of the Occupational Safety and Health Act of 1970: "The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that the employees were exposed to fire hazards. Beet Pulp Pelletizing Area: a) On or about October 12, 2008, and at times prior thereto, the company was drawing dust through a dust collection system where some component materials of construction of that intake duct work was PVC piping, a combustible material. b) On or about October 12, 2008, and at times prior thereto, the company was conveying dust through conductive duct work (PVC) in the dust collection system. Among other feasible abatement methods to correct this hazard is to provide non combustible and non conductive materials of construction in the dust collection system.
