Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazards of being struck-by vehicular traffic:
(a) Roadway Work Zone; U.S. Highway 89; East of Great Falls, MT;
Employees working
in a traffic zone were exposed to the hazard of being struck by vehicular
traffic
while not
wearing a traffic vest.
Among other methods, recognized and feasible means of abatement to correct
this hazard is
to ensure that employees who work in traffic zones wear suitable traffic
vests that comply
with performance specifications for reflective materials required in
ANSI/ISEA 107-2004
when performing work that affects highway and street traffic.
