Section 5(a)(1) of the Occupational and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employee were exposed to: (a) Employees were exposed to a struck-by hazard that was associated with using a Garlock trash chute that was approximately 50 feet above the ground and was not securely attached to the building in accordance to the manufacturers recommendations. One feasible and acceptable method to abate this hazard is to follow the manufacturers recommendation for the installation of the Garlock trash chute.
