estaban expuestos

Section 6 (h) of the Puerto Rico Occupational Safety and Health Act: Each
owner of any
premises used in whole or in part as a place of employment, did not comply
with all the
occupational safety and health standards and all rules, regulations and
orders issued pursuant to
this act, with respect to those parts of the premises under his control
and
not under the control
of the employer.

Cada dueno de
cualquier local usado todo en parte como sitio de empleo, no cumplio con
todas las normas de
salud y seguridad ocupacional y todas las reglas, reglamentos y ordenes
emitidas de acuerdo con
esta ley, respecto a aquellas partes de local bajo su control y no bajo el
control de patrono.
At the gate entrance for trucks of Pitusa San Juan warehouse, in November
2009 with
the knowledge of Pitusa, the neighbor bussiness,"Oratorio San Juan Bosco"
removed the
end pole where the gate was closed. They placed a concrete barrier used on
highways
to separate traffic as a subtitute of the removed pole, due to that fact
the force of
momentum created on the top of the gate was transmited to the ground
support of the
gate. The pressure exerted on the ground support weakened them and on
January
11,
2010 the gate, which it dimensios were twelve (12) feet of height and
twenty one (21)
feet of wide approximately, fell on top of an employee that was opening
the gate and
killed him. Pitusa was the owner of the gate and was responsible for
inspecting and
repairing.
Hazard: Stroke by a gate.
En el porton de entrada para camiones del almacen de Pitusa en San Juan,
en noviembre
de 2009 con el conocimiento de Pitusa, negocio aledano, Oratorio San Juan
Bosco,
removio el poste donde el porton se cerraba. Colocaron una barrera de
concreto usada
en las carreteras para separar el trafico como un sustituto del poste
removido. La barrera
quedaba mas baja que el poste removido, debido a ese factor la fuerza de
momento de
inercia creada en la parte superior del porton que se transmitio en los
soportes inferiores
del porton. La presion ejercida en los soportes inferiores los debilito y
el 11 de enero de
2010 el porton, cuyas dimensiones eran doce (12) pies de altura y veintiun
(21) pies de
ancho aproximadamente, cayo encima de un empleado que estaba abriendo el
porton
ocacionandole la muerte. Pitusa era el dueno del porton y era responsable
de la
inspeccion y reparacion del mismo.
