North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by or crushed by a forklift in that the employer did not ensure that the seat belt provided on a forklift was used by the operator: a)cutting department; a forklift operator operating the #25 Komatsu Type LP forklift, model FG25ST-12, serial #562542A, on August 6, 2007 was not wearing the seat belt that was installed on the forklift. Among other methods, one feasible and acceptable means of abatement is to require operators to wear the seat belts installed on the forklifts.
