North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment fee of recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by or crushed by a powered industrial truck in the event of an upset: a)establishment - an employee was not wearing a seatbelt while operating a Hyster forklift which could result in the employee being thrown from the lift truck in case of a vehicular accident. One feasible and acceptable abatement method to correct this hazard is to provide refresher training for the employees and enforce a discipline policy requiring employees to use the seatbelt available when operating the lift.ting
