Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish a place of employment which was free from recognized hazards that were likely to cause death or serious physical harm to employees in that an employee was exposed to serious fall and caught in between hazards as a result of riding in an elevated bucket of a hydraulic excavator. On September 11, 2007, an employee was exposed to a fall hazard of approximately 8 feet while riding a bucket of a New Holland hydraulic excavator to exit a trench with a piece of equipment. Among other methods, feasible and acceptable abatement methods could include, but are not limited to: Following the Equipment Manufacturers Institute (EMI) Safety Manual for Hydraulic Excavators states the following on page 20, "Never use a bucket for a work platform or personnel carrier." Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c)ts
