Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of being struck by high pressure water or flying parts and pieces from 14" core pipe x 6" flange jacketed M-control valve: a) Test area by Shipping Department - Employees, including engineer, designer, and shop personnel were exposed to the hazards of being struck by high pressure water or flying steel parts and pieces during the hydraulic testing of high pressure piping valves. Valves were tested to over 8000 psi and no barrier guards or other controls were in place to protect employee from struck by hazards on or about November 7, 2007. Among other methods, one feasible and acceptable abatement method to correct this hazard would be to install barrier guards between the system being tested and the personnel running the tests. Additional control would include limiting the number of personnel in the tests areas and developing standard operation procedures for running these tests.
