Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries due to improperly maintained steel storage shelving and racks. a) Warehouse - On or about April 22, 2008, the rear cross bar of a USP steel storage shelving system located in Aisle J between sections J13 and J15 was not fully secured. Only one of the teardrop stud and keyhole slot connections was partially engaged, exposing employees to the hazard of being crushed by unsecured rack components and stored materials while working in the vicinity of the overhead storage. b) Warehouse - On or about April 22, 2008, locking tabs on the teardrop stud and keyhole slot on an upper shelf frontal cross bar of a USP steel shelving system located in Aisle Q/R was not engaged, exposing employees to the hazard of being crushed by unsecured rack components and stored materials while working in the vicinity of the overhead storage. ABATEMENT NOTE: Among other methods, one feasible and acceptable abatement is to ensure the structural integrity of the storage racks is maintained through a program of routine inspections to identify those conditions that require repair and/or replacement of missing or damaged parts in accordance with ANSI MH16.1 - 2004, Specification for the Design, Testing and Utilization of Industrial Steel Storage Racks, section 1.4 Integrity of Rack Installations. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.tives
