Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of falling to the ground below in that: a) On or about July 11, 2007, at the entrance of Manor Creek, New Braunfels, TX, employees were riding the bucket of a Bobcat to the second level of scaffolding without protection from falls. Among other methods to protect employees, one feasible and acceptable method would be to prohibit employees from riding in the bucket of equipment and to provide a ladder or other safe means of ascending or descending structures.
