Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of falling from an elevated bucket. a) An employee was exposed to a fall hazard of approximately 8 feet while emptying the materials from the bucket to the top of the first tier of a tubular welded scaffolding using a Bobcat 863 F-Series skid steer loader. Among other feasible and acceptable means of abatement one method af abatement would be to use equipment manufactured for this purpose such as an aerial lift or a hoisting system.
