29 CFR 1926.451(a)(6): Scaffolds were not designed by a qualified person:    On or about March 26, 2015, and at times prior thereto, a platform (pallet/box) was supported by rough terrain forklift and was used to elevate personnel for masonry activities. The employer who designed the platform (pallet/box) was not qualified and/or did not adhere to published guidelines for safe use and design of elevating platforms and rough terrain forklifts, such as ASME/ANSI B56.6, 2005 and specifically, section 8.24, items such as:    a)  A platform floor having slip resistant surface.  b)  A 4 inch minimum height toe plate which may be omitted at the access opening.  c) Protection for personnel in their normal working position on the platform from moving parts of the rough terrain forklift truck that present a hazard.  d) A means to securely attach the platform to the lifting mechanism, and to prevent the platform from inadvertent pivoting.  e) Restraining means such as a guardrails or a means for securing personnel such as a fall protection harness.    Employees were exposed to pivoting, slippage or tipping of the platform and forklift creating a fall hazard of approximately 14 feet.

29 CFR 1926.451(f)(3): Scaffolds and scaffold components were not inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity:  On or about March 26, 2015 an at times prior thereto, the employer did not have a competent person perform daily inspections of the scaffold platform (pallet/box), exposing employees to the hazards of falls and/or scaffold collapse/failure.

29 CFR 1926.602(c)(1)(ii): Modifications or additions which affect the capacity or safe operation of the equipment were made without the manufacturer's written approval:  On or about March 26, 2015 and at times prior thereto, a rough terrain forklift was used to elevate personnel for construction work. The employer did not consult the manufacturer on the design of the platform and necessary changes to the forklift operational decals. Employees were exposed to the hazards of falls up to approximately 14 feet and/or scaffold collapse/failure.

29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment were used to support scaffold platforms when they were not specifically designed by the manufacturer for such use:    On or about March, 26, 2015, and at times prior thereto, a platform (pallet/box) installed on the Gradall rough terrain forklift was used to elevate personnel to perform work on the building under construction. The forklift was not designed for such use per the manufacturer's operations manual, exposing employees to the hazard of falling approximately 14 feet.

29 CFR 1926.451(c)(2)(v): Fork-lifts were used to support scaffold platforms while the entire platform was not attached to the fork and the fork-lift was moved horizontally while the platform was occupied:   On or about March 26, 2015, an employee working from an elevated platform (pallet/box) that was not securely attached to the lift to prevent the platform from sliding off. The platform was used with the Gradall rough terrain forklift to access elevated positions on the building under construction, exposing employees to a fall hazard of approximately 14 feet.

29 CFR 1926.602(d): The requirements applicable to construction work under this paragraph are identical to those set forth at 1910.178(l) of this chapter.    Each powered industrial truck operator did not complete training as required.    29 CFR 1910.178(l)(1)(ii) Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer shall ensure that each operator has successfully completed the training required by this paragraph (l), except as permitted by paragraph (l)(5).    On or about March 26, 2015, and at times prior thereto, the employer did not ensure that the operator of the Gradall rough terrain forklift, model 534C-9 was trained and certified in the safe operations of forklift.

29 CFR 1926.451(e)(1): When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface shall be used. Crossbraces were used as a means of access.  On or about March 26, 2015, and at times prior thereto, the employer did not ensure that employees used a scaffold ladder to gain access to the four tier tubular welded frame scaffolding, exposing employees to the hazard of falling up to 28 feet.   The Montecillo Masonry Company was previously cited twice for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(e)(1), which were contained in OSHA inspection numbers 314303405 & 941441, citation numbers 01&01, items 004&002 and were affirmed as a final order on February 14, 2011 & November 15, 2013 with respect to the workplaces located at 460 U.S. Hwy 79, Hutto, TX 78634 & Stone Hill Center, Tract 3B & 4B, Pflugerville, TX 78660.
