Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of being struck by equipment and/or material: ***Certification AND Documentation of Abatement Required*** a) The employer does not ensure that laundry bags weighing approximately 240 pounds each, transported on an over-head, gravity-fed trolley system, are prevented from falling into walk ways, exposing employees below to the hazard of being struck by falling bags. This violation was found to exist at the plant located at 1307 Smith Rd, Austin, TX, on or about February 21, 2008, where employees were required to operate the Health Care CBW and sort soiled laundry in the F&B department and the safety nets above had holes in them, makeshift repairs and were missing in some areas. One feasible and acceptable abatement method, among others, to correct this hazard is to repair holes in the existing safety nets, replace nets that are missing and maintain all such safety nets. b) The employer does not ensure that the operator of the hamper dumper in the F&B receiving department is able to see behind the hamper dumper when it is in the elevated position, exposing employees to the hazard of being struck by the hydraulic machine when it is lowered to the ground. This violation was found to exist at the plant located at 1307 Smith Rd, Austin, TX, on or about February 21, 2008, where employees were required to walk near the hamper dumper. One feasible and acceptable abatement method, among others, to correct this hazard is to barricade or install railings around the back of the machine to prevent entry. c) The employer does not ensure that rigging equipment is properly securing wire rope cables, exposing employees to a falling load due to improperly fastened Crosby clips on the F&B hoist. This violation was found to exist at the plant located at 1307 Smith Rd, Austin, TX, on or about February 21, 2008, where employees were operating the lift and working below the lift. One feasible and acceptable abatement method, among others, to correct this hazard is to install the wire rope clips with the saddle on the live end of the wire rope as per Crosby recommendations. d) The employer does not ensure that a 1-Ton hoist is secured to the structural over-head member by approved means, where a job made chain with a bolt connecting the links was used instead. The hoist is over the bar screen pit in the small washer room, exposing employees to the hazard of being struck by a falling load. This violation was found to exist at the plant located at 1307 Smith Rd, Austin, TX, on or about February 22, 2008, where employees were required to lift floor grates to clean the bar screen pit. One feasible and acceptable abatement method, among others, to correct this hazard is to provide only components that are approved and load tested. Pursuant to 29 CFR 1903.19(d), Immediately Upon Receipt of Citation, the employer must submit an abatement plan describing the actions it is taking to ensure that employees are protected from being struck by equipment such as, but not limited to laundry bags, hamperdumper, and falling loads from the hoist. This violation must be abated no longer than 10 days from receipt of this citation.
